Privacy Policy
Beyond Obesity has instituted a comprehensive set of privacy policies and procedures to protect the security and privacy of its customer’s personal data. Therefore, it conducts its business in compliance with applicable laws on data privacy protection and data security.
The purpose of the policy outlined below is to inform customers what data Beyond Obesity collects, how the information is gathered, how it is utilized, how long it is retained, how it is secured and how customers and visitors can restrict its use or disclosure.
Personal Data is a portion of the personal information which can be associated with a specific individual, entity or device. Examples include customer name, date of birth, address, telephone number, e-mail address, partial or full social security number, device ID and geolocation. The collection of customer identifiable information is a critical element in Beyond Obesity's day-to-day operations in order to conduct business and offer services and to maintain the highest level of customer service for all customers. Beyond Obesity endeavors to safeguard the customer identifiable information obtained from any unauthorized intrusions.
Personal and sensitive user data includes, but isn't limited to, personally identifiable information, financial and payment information, authentication information, phonebook, contacts, device location, SMS and call-related data, health data, Health Connect data, inventory of other apps on the device, microphone, camera, and other sensitive device or usage data. Beyond Obesity handles personal and sensitive user data, and therefore:
• Limits the access, collection, use and sharing of personal and sensitive user data acquired through the app to app and service functionality and policy-conforming purposes reasonably expected by the user:
- Apps that extend usage of personal and sensitive user data for serving advertising must comply with Google Play’s Ads policy.
• Beyond Obesity may also transfer data as necessary to service providers or for legal reasons such as to comply with a valid governmental request, applicable law, or as part of a merger or acquisition with legally adequate notice to users.
• Handles all personal and sensitive user data securely, including transmitting it using modern cryptography (for example, over HTTPS).
• Uses a runtime permissions request whenever available, prior to accessing data gated by Android permissions.
• Not sell personal and sensitive user data.
- "Sale" means the exchange or transfer of personal and sensitive user data to a third party for monetary consideration.
- User-initiated transfer of personal and sensitive user data (for example, when the user is using a feature of the app to transfer a file to a third party, or when the user chooses to use a dedicated purpose research study app), is not regarded as sale.
In cases where Beyond Obesity app’s access, collection, use, or sharing of personal and sensitive user data may not be within the reasonable expectation of the user of the product or feature in question (for example, if data collection occurs in the background when the user is not engaging with Beyond Obesity app), Beyond Obesity will meet the following requirements:
Prominent disclosure: Beyond Obesity shall provide an in-app disclosure of the data access, collection, use, and sharing. The in-app disclosure:
• Will be within the app itself, not only in the app description or on a website;
• Will be displayed in the normal usage of the app and not require the user to navigate into a menu or settings;
• Will describe the data being accessed or collected;
• Will explain how the data will be used and/or shared;
• Cannot only be placed in a privacy policy or terms of service; and
• Cannot be included with other disclosures unrelated to personal and sensitive user data collection.
Consent and runtime permissions: Requests for in-app user consent and runtime permission requests must be immediately preceded by an in-app disclosure that meets the requirement of this policy. The app's request for consent:
• Will present the consent dialog clearly and unambiguously;
• Will require affirmative user action (for example, tap to accept, tick a check-box);
• Will not interpret navigation away from the disclosure (including tapping away or pressing the back or home button) as consent;
• Will not use auto-dismissing or expiring messages as a means of obtaining user consent; and
• Will be granted by the user before your app can begin to collect or access the personal and sensitive user data.
Beyond Obesity app handles financial or Beyond Obesity app will never publicly disclose any personal and payment information or government sensitive user data related to financial or payment activities or any identification numbers government identification numbers.
Beyond Obesity app handles non-public Beyond Obesity doesn't allow unauthorized publishing or phonebook or contact information disclosure of people's non-public contacts.
Beyond Obesity app contains anti-virus or Beyond Obesity app posts up a privacy policy that, together with security functionality, such as anti-virus, any in-app disclosures, explains what user data your app collects anti-malware, or security-related features and transmits, how it's used, and the type of parties with whom it's shared.
Beyond Obesity app collects or links Persistent device identifiers may not be linked to other personal persistent device identifiers (for and sensitive user data or resettable device identifiers except for example, IMEI, IMSI, SIM Serial #, etc.) the purposes of
• Telephony linked to a SIM identity (for example, wifi calling linked to a carrier account), and
• Enterprise device management apps using device owner mode.
Beyond Obesity shall ensure that all its developers must complete a clear and accurate Data safety section for every app detailing collection, use, and sharing of user data. The developer is responsible for the accuracy of the label and keeping this information up-to-date.
Beyond Obesity shall post a privacy policy link in the designated field within Play Console, and a privacy policy link or text within the app itself. The privacy policy must, together with any in-app disclosures, comprehensively disclose how our app accesses, collects, uses, and shares user data, not limited by the data disclosed in the Data safety section. This must include:
- Developer information and a privacy point of contact or a mechanism to submit inquiries.
- Disclosing the types of personal and sensitive user data your app accesses, collects, uses, and shares; and any parties with which any personal or sensitive user data is shared.
- Secure data handling procedures for personal and sensitive user data.
- The developer’s data retention and deletion policy. - Clear labeling as a privacy policy.
Beyond Obesity allows users to create an account from within its app, as well as also allows users to request for their account to be deleted. Beyond Obesity undertakes to provide users with a readily discoverable option to initiate app account deletion from within its app and outside of its app.
When we delete an app account based on a user’s request, we ensure to also delete the user data associated with that app account. Temporary account deactivation, disabling, or “freezing” the app account does not qualify as account deletion. If we ever need to retain certain data for legitimate reasons such as security, fraud prevention, or regulatory compliance, we shall clearly inform users about your data retention practices.
Android will introduce a new ID to support essential use cases such as analytics and fraud prevention. Terms for the use of this ID are below.
• Usage: App set ID must not be used for ads personalization and ads measurement.
• Association with personally-identifiable information or other identifiers: App set ID may not be connected to any Android identifiers (for example, AAID) or any personal and sensitive data for advertising purposes.
• Transparency and consent: The collection and use of the app set ID and commitment to these terms must be disclosed to users in a legally adequate privacy notification, including our privacy policy. We shall obtain users’ legally valid consent where required. To learn more about our privacy standards, please review our User Data policy.
If we access, use, or process personal information made available by Google that directly or indirectly identifies an individual and that originated in the European Union or Switzerland (“EU Personal Information”), then we undertake to:
• Comply with all applicable privacy, data security, and data protection laws, directives, regulations, and rules;
• Access, use or process EU Personal Information only for purposes that are consistent with the consent obtained from the individual to whom the EU Personal Information relates;
• Implement appropriate organizational and technical measures to protect EU Personal Information against loss, misuse, and unauthorized or unlawful access, disclosure, alteration and destruction; and
• Provide the same level of protection as is required by the Privacy Shield Principles.
Beyond Obesity monitors its continuous compliance with these conditions on a regular basis. If, at any time, we cannot meet these conditions (or if there is a significant risk that we may not be able to meet them), users must immediately notify us by email to [insert email] and immediately either stop processing EU Personal Information or take reasonable and appropriate steps to restore an adequate level of protection.
As of July 16, 2020, Google no longer relies on the EU-U.S. Privacy Shield to transfer personal data that originated in the European Economic Area or the UK to the United States. (Learn More.) More information is set forth in Section 9 of the DDA.
This information is a subset of the personal Information that is generated in connection with the telecommunications services we provide to you. CPNI includes, for example, call details, call location information, and certain information about your rate plans and features. CPNI does not include your name, address, and phone number.
How information is collected:
Beyond Obesity collects personal and non-personal information from customers based upon our business relationship and the nature of the products and services we provide. You supply information to us when you use our products and services, make a purchase from us, or when you establish or modify an online account. Additionally, you may also provide us with information when you interact with our customer service representatives or participate in online surveys.
We also automatically collect information associated with your use of your device and our products and services.
When you do provide us with personal data, we usually use it to respond to your inquiry, process your order. Also, to support our customer relationship with you:
- we (or a third party on our behalf) may use personal data to contact you about an offer in support of your business needs or to conduct online surveys to understand better our customers' needs.
If you choose not to have your personal data used to support our customer relationship, we will respect your choice. We do not sell or otherwise market your personal data to third parties.
Beyond Obesity will collect, use or disclose personal data supplied by you online only for the purposes disclosed to you, unless the disclosure:
- is a use of the personal data for any additional purpose that is directly related to the original purpose for which the personal data was collected,
- is necessary to prepare, negotiate and perform a contract with you,
- is required by law or the competent governmental or judicial authorities,
- is necessary to establish or preserve a legal claim or defense, - is necessary to prevent fraud or other illegal activities.
When Beyond Obesity uses third parties to perform services on its behalf, such as marketing, fulfillment services, Beyond Obesity will request that such third parties protect your customer identifiable information consistently with this privacy policy. Beyond Obesity will not, however, disclose your customer identifiable information to third parties who want to market products to you without your express, written or equivalent electronic consent. Beyond Obesity will not sell, trade, or disclose to third parties any customer identifiable information derived from the registration for, or use of, an Beyond Obesity product or service -- including customer names and addresses -- without the consent of the customer.
Beyond Obesity may, however, use and/or disclose customer identifiable information to a third party:
to investigate and help prevent potential fraud, other unlawful activity or activity that threatens a service network;
as required by law, such as to comply with a subpoena, or similar legal process; when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request;
How long your information is retained:
We will retain your information only as long as needed for business, tax and/or legal purposes. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes and enforce our agreements. We will destroy your information once it is no longer needed.
Upon request, Beyond Obesity will provide you with information about whether we hold any of your personal information. You may access, correct, or request deletion of your personal information.
To protect your personal data against accidental or unlawful destruction, loss or alteration and against unauthorized disclosure or access, Beyond Obesity uses technical and organizational security measures.
